User Content License

This User Content License ("License") is part of your agreement with YBuffet Inc. and governs how YBuffet may use content you create, upload, post, or otherwise submit to the Platform.
1. Your Ownership
You retain all ownership rights in content you submit to the Platform ("Your Content"). This License does not transfer ownership of Your Content to YBuffet.
2. License You Grant to YBuffet
By submitting content to the Platform, you grant YBuffet a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:
Host, store, and display Your Content on the Platform
Reproduce and distribute Your Content to other Platform users as part of the Platform’s normal operation
Format, resize, or technically modify Your Content for display purposes without changing its meaning
Index Your Content to enable search functionality within the Platform
Use Your Content in aggregate or de-identified form for analytics, research, and Platform improvement
This license lasts until you delete Your Content or close your account, at which point it terminates except where: (a) Your Content has been shared with other users who have not deleted it; (b) backup or legal retention obligations apply; or (c) the content was included in Platform operations that cannot reasonably be unwound.
3. Promotional Use and Right of Publicity
YBuffet would like to use certain content and user information for promotional purposes, such as case studies, testimonials, social media posts, and marketing materials. California law (Civil Code § 3344) and equivalent laws in other states give individuals the right to control commercial use of their name, photo, voice, and likeness.
Promotional Use Requires Separate Opt-In Consent: YBuffet will NOT use your name, photo, likeness, company name, or profile information for external promotional or marketing purposes unless you have given explicit, separate consent. This consent is collected through a clearly labeled opt-in checkbox in your account settings under "Profile Visibility & Promotions." Agreeing to these Terms of Service or this License alone does NOT constitute consent for promotional use of your identity or likeness. You may withdraw promotional consent at any time through your account settings without affecting your right to use the Platform.
What Promotional Use Means: If you opt in, you consent to YBuffet using your name, company name, profile photo, and general description of services or experience (not private messages or confidential information) in: blog posts, case studies, testimonials, social media posts, press releases, and investor materials. YBuffet will not misrepresent your views or create false impressions about your endorsement of YBuffet products.
What Is Not Promotional Use: Displaying your profile, listings, and content on the Platform as part of its normal operation is not promotional use and does not require separate consent -- it is covered by the Platform license in Section 2 above.
4. AI Training
YBuffet may use Your Content in aggregate or de-identified form to train, test, and improve AI and machine learning systems used within the Platform. We will not use identifiable personal information from Your Content for AI training without your separate consent. You may opt out of AI training use of Your Content by contacting grow@ybuffet.com.
5. Your Representations
By submitting content, you represent and warrant that:
You own Your Content or have all necessary rights, licenses, and permissions to submit it and grant this License
Your Content does not infringe any third-party copyright, trademark, privacy, publicity, or other rights
Your Content does not contain any viruses, malware, or harmful code
Your Content complies with our Community Guidelines and applicable law
You are solely responsible for Your Content and any consequences of posting it.
6. YBuffet Content
All content created by or for YBuffet on the Platform, including design, code, logos, and original written content, is owned by YBuffet and protected by applicable intellectual property laws. You may not use YBuffet’s content without our written permission.
7. DMCA and Copyright Complaints
If you believe content on the Platform infringes your copyright, please send a compliant DMCA takedown notice to grow@ybuffet.com with: (a) identification of the copyrighted work; (b) identification of the infringing content and its location on the Platform; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner. We will respond to valid DMCA notices promptly. See our IP Policy for full details.
8. AI-Generated Content
If you submit content to the Platform that was generated in whole or in part by an AI tool, you represent that:
You have reviewed the content and take responsibility for its accuracy and compliance with these Terms
You will not misrepresent AI-generated content as human-authored in contexts where that distinction is material, including professional credentials, portfolio work, or expert opinions
You understand that AI-generated content may be subject to third-party terms depending on the tool used, and you have complied with those terms
9. Changes to This License
We may update this License from time to time. We will notify you of material changes at least 30 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance.
